At Combrink Nel & Associates, we take pride in our unwavering commitment to justice and our dedication to securing favourable outcomes for our clients. Recently, our legal expertise and strategic acumen were put to the test in a case representing Ms. Betty against a large commercial bank.
Ms. Betty, whose name has been changed to protect her identity, faced a challenging situation. She had been employed by a business brought over by the Respondent in 2003 and was subsequently transferred to a large commercial bank on January 1, 2023, following a merger. However, upon her retirement in June 2023, she discovered that she was not paid the retirement legacy bonus she believed she was entitled to according to the bank’s policy.
Enter Combrink Nel & Associates. With our skilled legal team led by Mr. Combrink Nel, we took on Ms. Betty’s case with determination and expertise. The arbitration, which took place on February 12, 2024, was a pivotal moment in our client’s pursuit of justice.
Our team meticulously examined the evidence presented, including testimonies and documentation, to construct a robust case on behalf of Ms. Betty. We argued that as a full-time employee of the large commercial bank, she should have been entitled to the legacy bonus according to the bank’s policy.
Despite the bank’s arguments to the contrary, we demonstrated that Ms. Betty met the eligibility criteria outlined in the bank’s policy. Through careful analysis and legal reasoning, we showed that the bank’s conduct in denying her the benefit constituted an unfair labour practice.
In the end, our efforts yielded positive results. Commissioner Xoliseka Santi, after considering the evidence and arguments presented, ruled in favour of Ms. Betty. The large commercial bank was ordered to pay Ms. Betty the legacy bonus amount she rightfully deserved.
This victory underscores the importance of skilled legal representation in navigating complex legal matters. At Combrink Nel & Associates, we are committed to upholding the rights of our clients and fighting tirelessly on their behalf. We are proud to have achieved justice for Ms. Betty and will continue to advocate for individuals facing similar challenges.
