2. Securing the Purchase Price
The terms of payment for the purchase price are outlined in the Offer to Purchase. The buyer can make the payment in cash, through bank finance, or a combination of both. If bank finance is involved, the purchaser applies for a loan, and upon approval, a bond registration attorney is appointed by the bank. The transferring attorney collaborates with the bond registration attorney to secure guarantees for the purchase price and coordinate the simultaneous registration of the transfer and mortgage bond.
3. Obtain Relevant Documents
Various documents are requisite during the transfer process, depending on the transaction’s nature. These include bond cancellation figures, rates clearance figures, levy clearance figures, and a transfer duty receipt or exemption certificate from SARS.
4. Sign Transfer Documents
The transferring attorney facilitates the preparation and signing of transfer documents by both the seller and the purchaser. FICA affidavits confirming personal particulars, SARS transfer duty declarations, and a Power of Attorney to pass the transfer are essential components. The Power of Attorney empowers the conveyancer to oversee the transfer on behalf of the seller.
5. Obtain Clearance Certificates
Transfer costs, including transfer duty payable to SARS, are paid by the purchaser to the transferring attorney. The seller is responsible for municipal and levy-clearance figures, as well as compliance certificates such as electrical compliance, gas compliance, and electrical fence certificates if applicable.
6. Lodge in Deeds Office
Upon ensuring all documents are in order, they are submitted to the deeds office for registration. If different attorneys are involved, their documents are linked and lodged simultaneously. This includes consent to cancel the seller’s existing mortgage bond and the buyer’s mortgage bond.
7. Registration and Finances
The registration process in the deeds office typically takes 8-10 working days. Once completed, a new title deed is issued, confirming the purchaser as the registered property owner. The transferring attorney finalizes financial statements and disburses the sale proceeds to the seller.
